WAFA LOYALTY PROGRAMME TERMS AND CONDITIONS

The Wafa Loyalty Programme (“Wafa”) is operated by Aswaaq Retail LLC/GMG Consumer LLC (“Aswaaq” or “GMG”). The Wafa rewards can be availed through Aswaaq store point of service, and are offered to customers, subject to the acceptance of these Terms and Conditions (“Terms”), as amended or modified from time to time. By registering for Wafa or continuing your use of Wafa, you have consented to these Terms.

Notice:
Effective 8th December 2023, the Wafa mobile application (“App”) currently available on iOS and Android platforms will be terminated and no longer accessible for download or use. All Wafa programme functionality and operations will be exclusively managed and accessible through the cashier/point of sale. All Wafa members will now solely interact with cashiers to accumulate Wafa points, redeem Wafa points or engage in any other Wafa related activities.

As of the aforementioned date, the App will cease to function, and all services, features, and functionalities provided by the App will be discontinued. This termination includes, but is not limited to, access to content, account management, and any associated services linked to the App.

Membership

Membership Details:
– Wafa is available to any person over the age of eighteen (18) years old.
– Aswaaq reserves the right to accept or reject any application for Wafa membership at its sole and absolute discretion.
– If an application for membership is rejected or cancelled, any benefit that may have accrued to the applicant through Wafa will be null and void.
– Wafa is free of charge and open to all Aswaaq customers, and available through Aswaaq’s website and store point of service, upon completing the required registration details.
– Wafa membership is open for life, however, if the account is inactive or unusued for a period of over two (2) years, the Wafa membership would be designated as ‘dormant’ and the accrued Wafa points will expire.
– Wafa members must complete the registration process by providing current, complete and accurate information as prompted by the applicable registration form. The member will need to provide their full name, email address and mobile number. Each individual is responsible for the accuracy and completeness of the information provided for registration or any other information provided by such individual for Wafa.
– The Wafa member is responsible for updating his/her account with any changes to their contact information. Aswaaq reserves the right to require more information from the member to complete the registration.
– Wafa membership is not transferable, and any benefits / Wafa points cannot be assigned or transferred to any other member, unless otherwise in accordance with these Terms.

Membership Benefits:
All Wafa members are entitled to the following benefits:
– Earn Wafa points for eligible purchases
– Redeem accrued Wafa points against purchases 
– Up to 10% of monthly spent loaded as Wafa points in the Wafa membership account
– Exclusive promotions and offers

Earning points

Every purchase you make at any Aswaaq store contributes to your Wafa points. These points are calculated based on eligibility criteria and the table of benefits (refer to the table below). 

For your convenience, 1 Wafa point is equivalent to 1 UAE Fils, and every 100 Wafa points translate to 1 UAE Dirham.

100 Wafa points  = AED 1

Cash or Wafa points

A Wafa Member earn one (1) Wafa point for each Dirham spent in any Aswaaq store, excluding taxes and other fees. In case the payments are through cash or Wafa points, the additional points are calculated as follows:

10 % of your monthly spent:

If the monthly purchases are equal to or greater than AED 3,000, excluding taxes and other fees, a Wafa member will be entitled to earn nine (9) additional Wafa points for every AED 1 excluding taxes and other fees spent in any branch. Example: The total earned points would be ten (10) for every AED 1 which equals to 10% of your monthly spent loaded as points in the Wafa account.

5 % of your monthly spent:

If the monthly purchases are equal to AED 1,500 and less than AED 3,000, excluding taxes and other fees, a Wafa member will be entitled to earn four (4) additional Wafa points for every AED 1, excluding taxes and other fees, spent in any branch. Example: The total earned points would be five (5) for every AED 1 which equals to 5% of your monthly spent loaded as points in the Wafa account.

1% of your monthly spent:

If the monthly purchases are less than AED 1,500, excluding taxes and other fees, a Wafa member will be entitled to earn (1) Wafa point for every AED 1, excluding taxes and other fees, spent in any aswaaq store. Example: The total points earned would be one (1) for every AED 1 which equals to 1% of your monthly spent loaded as points in the Wafa account.

Payment by Card

In case the payments are done through credit cards, debit cards, ATM cards, Nol Cards or any way other than cash payment or through Wafa points, the additional points on monthly purchases will be calculated as follows, provided that the Wafa member shall maintain the earning of one (1) Wafa point for each Dirham spent in any branch, excluding taxes and other fees:

8 % of your monthly spent:

If the monthly purchases are equal to or greater than AED 3,000, excluding taxes and other fees, a Wafa member will be entitled to earn seven (7) additional Wafa points for every AED 1, excluding taxes and other fees, spent in any branch. Example: The total earned points would be eight (8) for every AED 1 which equals to 8% of your monthly spent loaded as points in the Wafa account.

3% of your monthly spent:

If the monthly purchases are equal to AED 1,500 and less than AED 3,000, excluding taxes and other fees, a Wafa member will be entitled to earn two (2) additional Wafa points for every AED 1, excluding taxes and other fees, spent in any branch. Example: The total earned points would be three (3) for every AED 1 which equals to 3% of your monthly spent loaded as points in the Wafa account.

1% of your monthly spent:

If the monthly purchases are less than AED 1,500, excluding taxes and other fees, a Wafa member will be entitled to earn (1) Wafa point for every AED 1, excluding taxes and other fees, spent in any aswaaq store. Example: The total points earned would be one (1) for every AED 1 which equals to 1% of your monthly spent loaded as points in the Wafa account.

Please Note: If an invoice is paid for in Cash and Card combined in a single transaction, the percentage on the entire transaction the Wafa member will earn would be based on card.

Paying with Wafa Points:

Wafa members can pay for purchased items using Wafa’s accrued loyalty points through the process of redemption.

Wafa Points Collection:

Wafa members can earn Wafa points by simply giving their registered mobile number or Wafa membership number to the cashier prior to the processing of their transaction to earn the Wafa points.

Wafa points may take up to thirty (30) to be credited to a Wafa member’s account. Wafa points earned by a Wafa member may only be redeemed by that member in accordance with these Terms once they have been credited to the relevant Wafa member account.

All Wafa points accrued by a Wafa member will be credited to their respective Wafa account only.

In the event of returns of product purchased using Wafa points, the proportionate amount will be refunded as store credit.

Wafa Points Redemption:

A Wafa member has the right to redeem his/her Wafa points and/or use them against purchases, according to the following steps:

  • Wafa members must present their Wafa membership number or provide their registered mobile number to the cashier before the transaction is processed;
  • A One Time Password (OTP) will be sent to the Wafa member’s registered mobile number to provide access to the Wafa points redemption;
  • Wafa members may redeem the accrued Wafa points for such purchase. Wafa members must have sufficient Wafa points in their Wafa membership account at the time of redeption;
  • Redeemed Wafa points will be deducted from the Wafa member’s account immediately after processing the payment; and
  • A receipt is issued for every redemption process.

 

Wafa members may redeem their Wafa points in full or in part Wafa points / part cash.

Miscellaneous

Validity of Wafa Points:

Earned Wafa points/credit in each Wafa member’s account will be valid for twenty-four (24) months from the date of earning and the points/credit will expire by the end of this period if not used or acquired by any means mentioned in these Terms.

Wafa members cannot claim any expired points/credit from their Wafa membership account.

Non-entitlement of Wafa Points:

A Wafa member cannot earn Wafa points in the following cases, which may be amended from time to time, or other purchases excluded by Aswaaq as its sole discretion:

  • If the total purchases of one item during a month exceeded AED 500;
  • Prepaid Cards i.e. NOL, Salik, Telephone Cards, iTunes, gift cards, etc.;
  • In case of purchasing a product subject to excise taxation customer will earn 1%. For the avoidance of doubt, regardless of any amount spent on products that are subject to excise taxes, you will only receive a 1% reward for purchasing such products; or
  • If a product purchased is returned.

The Products offered through promotional campagins are included to the points calculation.

Cancellation, Closure and Termination of Wafa membership:

  • Aswaaq may in its absolute discretion suspend, close or terminate a Wafa membership or a Wafa member’s accrued Wafa points at any time with or without cause or justification to the Wafa member as Aswaaq deems fit at its sole discretion.
  • If a Wafa member account is inactive or unusued for a period of over two (2) years, the Wafa membership would be designated as ‘dormant’ status. Dormant member accounts will not be accessible and the Wafa points accrued will expire.
  • To initiate the membership cancellation process, Wafa members can visit their nearest aswaaq store and submit their request at the Customer Service Counter. Aswaaq reserves the right to request appropriate identification and information from the Wafa member in order to process the cancellation process. If the balance of a member’s Wafa points/credit is below AED 100, they may only redeem it by making purchases at Aswaaq supermarket before proceeding with the cancellation. If cancelled, the Wafa points/credit accrued prior to cancellation must be redeemed for purchase within thirty (30) days from the date of cancellation.
  • Wafa membership will terminate immediately on notification of death or bankrupsy of a Wafa Member. Any Wafa points accumulated for a deceased or bankrupt Wafa member shall be void.
  • Aswaaq reserves the right to cancel any Wafa membership account without prior notice.

General terms

  • The Wafa member hereby understand and accept that IN NO EVENT SHALL ASWAAQ BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY LIABLITY OF WHATSOEVER NATURE ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE WAFA MEMBER’S USAGE OF WAFA, INCLUDING BUT NOT LIMITED TO LOSS OF POINTS AND / OR LOSS OF PERSONAL INFORMATION. THE WAFA MEMBER AGREES TO INDEMNIFY AND HOLD ASWAAQ HARMLESS AGAINST ANY THIRD-PARTY CLAIM THAT MIGHT BE ARISING FROM WAFA.
  • All conditions and warranties, whether expressed or implied and whether arising under legislation or otherwise, as to condition, suitability, quality, fitness or safety of any Wafa points awarded or products or services purchased are expressly excluded to the fullest extent permitted by law. Any liability that cannot be fully excluded is limited to replacing, repairing, or crediting the value of Wafa points redemption at Aswaaq’s sole discretion.
  • Each Wafa member is only entitled to hold one (1) Wafa membership account. Aswaaq shall have the right, without any demur by the Wafa member, to amend, adjoin, delete or cancel all or any of the multiple Wafa membership accounts or whole or part of the accumulated Wafa points of a Wafa member if he/she is found to have created more than one (1) Wafa account for accumulating Wafa points in a way that is, in Aswaaq’s sole opinion malicious or not in accordance with these Terms.
  • Wafa points cannot be sold or assigned to others or used as value in any other transaction other than those facilitated by Wafa in accordance with these Terms. Wafa members accept and acknowledge that Wafa points are solely for the purpose of redemption within Aswaaq Retail stores and cannot be redeemed for cash nor considered either exchangeable to monetary currency nor than it represents monetary assets of the Wafa member. Aswaaq may cancel any accured Wafa points or the whole or any part of Wafa as and when it deems fit without notice and without liability.
  • Aswaaq does not guarantee that the website, Wafa, or any content or feature on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website or Wafa for business or operational reasons.
  • Each Wafa member acknowledges and agrees to these Terms, and their use of Wafa is an implied acknowledgement and unconditional agreement with all the terms and conditions herein, as amended from time to time.
  • All exceptional or out of ordinary use of the Wafa membership or Wafa points accrued therein, as decided by Aswaaq, will be flagged and may lead to suspension of the related Wafa membership whilst the activity is under verification.
  • Aswaaq reserves the right to change, modify or amend any part of Wafa or these Terms at any time and without prior notice. Aswaaq will notify the modifications to these Terms on the website and by sending an email to Wafa members on their registered email addresses.
  • Wafa member’s use of Wafa any time or after any change or variation to these Terms or otherwise will be deemed to be an acceptance of such modification or update by the Wafa member. Wafa members shall be solely responsible to keep informed of the Terms, as amended from time to time.
    Aswaaq may change, restrict access to, suspend or discontinue Wafa, or any portion of Wafa, at any time without notice, refuting any liability whatsoever.
  • Aswaaq reserves the right to decide on the promotions and discounts offered to Wafa members. Any promotions or discounts offered in connection with Wafa are at Aswaaq’s sole discretion and are subject to any specific promotion or discount terms and conditions. Aswaaq may amend or withdraw such promotions or discounts or their terms and conditions at any time.
  • Each Wafa member is fully responsible for the safety and security of his/her account and pin number. Aswaaq shall not be held liable for any missing information or data or for any misuse of the account that may arise due to the negligence of a Wafa member.
  • Aswaaq is expressly exempted from any liability related directly or indirectly to this programme. It is also exempted from any legal use, fraudulent use, or any violation of these Terms.
  • These Terms shall be governed by the federal laws of the United Arab Emirates. Any dispute that arises from or related to the application of these terms and conditions shall be referred to the Customer Service through call center 800’aswaaq (279227) or email (wafa@aswaaqretail.ae); in the event that such dispute is not resolved amicably, the Wafa member irrevocably submits to resolve such dispute exclusively through the Dubai Courts.
  • Aswaaq reserves the right to collect the following information and each Wafa member consents to the same (“Information”):
    –Information provided as part of the membership application and any other information provided by the members through any source of communication.
    –Information related to transactions at any Aswaaq branch.
  • Aswaaq retains the Information throughout the active Wafa membership period to be able to provide the services related to Wafa. Aswaaq may retain the information even after the cancelation of the Wafa membership whenever necessary to comply with the company’s legal obligations or to meet the regulatory requirements or to prevent fraud and misuse or to enforce privacy policy (Aswaaq Privacy Policy available at aswaaq.ae/privacy-policy/ which is included by reference as an integral part of these Terms). Further, it may retain information, for a specified period, if requested by law enforcement.
  • Wafa members hereby authorizes Aswaaq to provide him/her with greetings on special occasions or to request feedback on products and services in addition to providing the members with the following:
    — Latest promotions and offers
    — Personalized customer service
  • These Terms contain the whole agreement relating to Wafa and supersedes all previous agreements between Aswaaq and Wafa members relating to it. Wafa members acknowledge that in agreeing to these Terms, they have not relied on any representation, warranty or other assurance except those set out in these Terms.
  • All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the website, and the Wafa programme belongs to Aswaaq, its group companies, licensors and/or third parties. Aswaaq reserves all of its rights in relation to Wafa and the website. Nothing in these Terms grants any Wafa member a right or licence to use any trade mark, design right or copyright owned or controlled by Aswaaq or any other third party.

Wafa members are encouraged to stay updated on Wafa programme announcements and terms through Aswaaq’s official communication channels.
